Product quality, returns and guarantees

1.  The Seller warrants to the Buyer that the goods sold are in conformity with the terms of the contract and that at the time of the conclusion of the contract the goods are free from latent defects known to the Seller which would prevent the goods from being used for their intended purpose.
2.  The Seller is not liable for defects resulting from the buyer’s breach of the rules for the use or storage of the goods, or from the fault or force majeure of third parties.
3.  The Buyer shall inspect the packaging, quantity, quality, variety and composition of the Goods within 14 (fourteen) days of delivery of the Goods. If the buyer does not submit a complaint to the seller within the time limit set, the goods are deemed to have been delivered in the correct packaging and to be in conformity with the terms of the contract in terms of quantity, quality, range and equipment. If discrepancies or defects are discovered within the time limit, the buyer must immediately inform the seller.
4.  The buyer has the right to replace the purchased goods with similar goods of different dimensions, shape, colour, design or perfection within fourteen days of delivery. If there is a price difference in the exchange of goods, the buyer must pay the recalculated prices to the seller. The time and place of exchange of the goods will be agreed with the Seller.
5.  If the Seller does not have goods suitable for exchange, the Buyer has the right to return the goods to the Seller and recover the price paid for them by giving prior written notice. The buyer’s claim for compensation is satisfied if the goods have not been used, have not been damaged, have not lost their consumer characteristics or their commercial appearance and the buyer has proof that he has bought the goods from the seller. The goods must be returned to the Seller immediately, but no later than 14 days from the date of the notice of withdrawal. The buyer must bear the direct costs (postage, courier, etc.) of returning the goods to the seller. Any money paid under a cancelled contract must be returned to the buyer within 14 days. after the Seller has received and assessed the returned product. The money will be returned in the same way as the buyer had paid, unless otherwise agreed.
6.  A buyer to whom goods of defective quality have been sold has the right to claim, at his option:
6.1.  that the seller will repair the defects in the goods free of charge within a reasonable time or reimburse the buyer for the cost of repairing the defects, if they can be repaired;
6.2.  that the goods described in the contract by type are replaced by goods of matching quality, unless the defects are minor or due to the buyer’s fault;
6.3.  reduce the purchase price accordingly;
6.4.  cancel the contract and require the seller to refund the price paid if the sale of a poor quality product is a material breach of contract. The buyer does not have the right to demand termination of the contract if the defect is minor. If the buyer cancels the contract due to the defective quality of the goods, the seller must immediately, but no later than 14 (fourteen) days after the date of return of the goods, refund the price paid. If only part of the goods are returned, the delivery costs will not be refunded.
7.  When returning goods, the following conditions must be met:
7.1.  The returned product must be in its original, clean packaging with original labels, protective bags and the same accessories as where it was sold.
7.2.  The buyer must return the product undamaged and unused (except in cases where a defective product is returned).
7.3.  The product must not have lost its commercial appearance (undamaged label, removable protective film, etc., except in cases where a defective product is returned). Changes in the appearance of the packaging which were necessary for the inspection of the goods received are not considered to be substantial changes in the appearance of the goods.
7.4.  The returned product must be in the same configuration as received by the buyer. At the same time, any gifts received for the product must be returned.
8.  After receiving the goods and assessing their quality, the Seller determines their value. The buyer is liable for the depreciation of the goods due to actions that are not necessary to determine the nature, characteristics and performance of the goods. T. y. The Seller has the right to unilaterally reduce the amount to be refunded to the Buyer in proportion to the aforementioned reduction in the value of the goods.
9.  The Seller has the right not to accept goods returned by the Buyer if the Buyer has breached his obligation to comply with the conditions applicable to the goods to be returned. The Buyer undertakes to compensate the Seller for any losses incurred in this respect and no money will be returned to the Buyer.
10.  Goods are exchanged or returned at the company’s premises or at another place and in the manner agreed with the buyer.
11.  Consumer disputes between the seller and the buyer will be settled in good faith at the addresses and means of communication indicated in the contact details.
